These Terms & Conditions (“Terms”) govern your access to and use of psychedhealth.com, the Psyched mobile app, beta products, therapist dashboard features, and related services provided by Psyched, Inc. (“Psyched,” “we,” “us,” or “our”).

By using Psyched, you agree to these Terms. If you do not agree, do not use Psyched.

1. What Psyched Is

Psyched is a behavioral insights platform for therapy. Psyched helps users capture mood, reflections, meaningful moments, calendar context, optional health-related signals, and therapy-prep items between therapy sessions.

Psyched may include:

  • A patient-facing reflection and therapy-prep app
  • Mood check-ins
  • Journal entries
  • Interaction and event logs
  • Therapy-prep summaries
  • Calendar-connected features
  • Optional Apple Health-related features
  • Optional AI-assisted summaries or pattern organization
  • Future therapist-facing dashboards or sharing features

Psyched is not an electronic health record, medical record system, clinical documentation system, therapist marketplace, crisis service, diagnosis tool, or replacement for therapy.

2. Beta Status

Psyched is currently in beta. Features may change, break, be removed, or be unavailable at any time. Beta features may use mock, test, or limited-production workflows.

Do not use Psyched as your only copy of important mental health notes, clinical records, emergency information, or therapy documentation.

3. Not Medical Advice or Therapy

Psyched does not provide medical advice, mental health diagnosis, therapy, treatment, crisis intervention, clinical decision-making, or emergency monitoring.

Any insights, summaries, prompts, or AI-generated outputs are for reflection and therapy preparation only. They may be inaccurate, incomplete, or not appropriate for your situation.

You are responsible for deciding what to share with your therapist or care provider. Therapists and providers remain responsible for their own clinical judgment, documentation, diagnosis, treatment, safety assessment, and legal obligations.

4. Crisis and Emergency Disclaimer

Psyched is not a crisis service and should not be used for emergencies.

If you believe you may hurt yourself or someone else, or if you are experiencing a medical or mental health emergency, call 911 or your local emergency number immediately.

If you are in the United States and experiencing suicidal thoughts or emotional crisis, you can call or text 988 to reach the Suicide & Crisis Lifeline.

Psyched does not monitor user entries in real time and does not guarantee that any therapist, provider, or Psyched team member will review your content.

5. Eligibility

You must be at least 18 years old to use Psyched unless we provide a specific legally compliant minor-use workflow.

By using Psyched, you represent that you are legally able to agree to these Terms.

6. Accounts

You may need to create an account to use certain features. You agree to provide accurate information and keep your account credentials secure.

You are responsible for activity that occurs through your account. Notify Psyched if you believe your account has been compromised.

7. User Content

You may enter, upload, save, or generate content in Psyched, including check-ins, journal entries, mood tags, reflections, therapy-prep items, goals, calendar-linked notes, and other information (“User Content”).

You retain ownership of your User Content.

You give Psyched permission to host, store, process, transmit, display, summarize, analyze, and otherwise use your User Content as needed to provide and improve Psyched, operate requested features, generate insights, maintain security, and comply with law.

You are responsible for your User Content and for ensuring that you have the right to enter or share it.

8. Sensitive Information

Psyched may allow you to enter sensitive mental health, relationship, calendar, wellness, or health-related information.

You should only enter information you are comfortable storing in Psyched. Do not enter information about another person unless you have the right to do so.

Do not use Psyched to store emergency instructions, active crisis communications, or information that must be reviewed urgently by a clinician.

9. Calendar Integrations

If you connect Google Calendar, Apple Calendar, Outlook Calendar, or another calendar service, Psyched may use calendar information to support schedule context, event reflections, calendar-load insights, reminders, and therapy-prep features.

You are responsible for managing calendar permissions through the relevant calendar provider and device settings.

Psyched does not guarantee the accuracy, completeness, or availability of third-party calendar data.

10. Apple Health and HealthKit

If you choose to connect Apple Health, Psyched may use authorized health and fitness data to provide user-facing features such as sleep summaries, exercise context, mood-pulse prompts, and body-signal reflection prompts.

Psyched does not use Apple Health data for advertising, marketing, or unrelated data mining.

Apple Health data and HealthKit features may be unavailable, inaccurate, delayed, or incomplete. Psyched does not provide medical interpretation of Apple Health data.

11. AI Features

Psyched may include AI-assisted features that organize, summarize, classify, or phrase information based on User Content and structured signals.

AI outputs are not clinical conclusions, medical advice, diagnosis, treatment recommendations, or safety assessments. AI outputs may be wrong, incomplete, or misleading.

Do not rely on AI outputs as a substitute for professional judgment, therapy, medical care, or emergency support.

12. Therapist Sharing

Psyched may allow users to share selected information with a therapist or care provider.

Therapist sharing is intended to be patient-controlled, permissioned, scoped, and revocable where available. A therapist does not automatically see your private entries unless you authorize sharing through available product features.

You understand that:

  • Sharing information through Psyched does not guarantee that a therapist will review it.
  • Psyched is not responsible for how a therapist interprets or uses information you choose to share.
  • Psyched is not a substitute for communicating directly with your therapist.
  • Psyched should not be used for urgent or crisis communication.

13. Therapist and Provider Users

If you use Psyched as a therapist, clinician, provider, supervisor, practice owner, or similar professional user, you agree that:

  • You are responsible for maintaining all required licenses, credentials, professional obligations, and legal compliance.
  • You will use Psyched only within the scope of your professional role and authority.
  • You will obtain any required patient consent before using Psyched in connection with patient care.
  • You will not rely on Psyched as your sole clinical record, diagnostic tool, treatment planning tool, safety monitoring system, or crisis workflow.
  • You remain responsible for clinical judgment, diagnosis, documentation, treatment decisions, safety assessment, billing, insurance documentation, and compliance with applicable law.
  • You will not represent that Psyched guarantees clinical outcomes, reimbursement, medical necessity, or insurance coverage.

14. HIPAA and Compliance

Psyched is being built with HIPAA-ready architecture in mind, but Psyched does not claim to be HIPAA compliant unless the required legal, technical, operational, and contractual requirements are in place.

If Psyched enters into a business associate relationship with a HIPAA-regulated entity, separate agreements and requirements may apply.

Unless a separate written agreement says otherwise, you may not use Psyched as a HIPAA-compliant system of record or as a replacement for your EHR, clinical notes, practice management system, or required legal documentation.

15. Subscriptions and Payments

Psyched may offer paid features, subscriptions, therapist seats, patient premium features, or other paid services.

Prices, billing periods, included features, renewal terms, cancellation rules, and refund rules will be shown at the time of purchase or in the applicable order form.

If you purchase through Apple, Google, Stripe, or another payment provider, that provider’s payment terms may also apply. You are responsible for managing cancellations through the platform or payment provider used for purchase.

Psyched may change pricing or paid features prospectively, subject to applicable law and any commitments made at the time of purchase.

16. Acceptable Use

You agree not to:

  • Use Psyched for unlawful, harmful, fraudulent, abusive, or exploitative purposes
  • Attempt to access another user’s account or data
  • Upload malicious code or interfere with Psyched systems
  • Reverse engineer, scrape, or attempt to extract source code or non-public data
  • Misrepresent your identity, credentials, or relationship to another person
  • Use Psyched to harass, threaten, or harm others
  • Use Psyched as an emergency, crisis, or real-time monitoring system
  • Enter information you do not have the right to use or share
  • Use Psyched in a way that violates professional, privacy, or health care laws applicable to you

17. Intellectual Property

Psyched owns the website, app, software, design, branding, logos, text, workflows, graphics, and other materials that are part of the service, except for User Content and third-party materials.

You may not copy, reproduce, modify, distribute, sell, or create derivative works from Psyched materials without written permission.

18. Feedback

If you provide ideas, suggestions, bug reports, feature requests, or other feedback, you give Psyched permission to use that feedback without restriction or compensation.

19. Third-Party Services

Psyched may integrate with third-party services such as authentication providers, cloud infrastructure providers, calendar providers, Apple Health, payment processors, email tools, analytics or security tools, and AI processing providers.

Psyched is not responsible for third-party services, their availability, their terms, or their privacy practices.

20. Disclaimers

Psyched is provided “as is” and “as available.”

To the fullest extent permitted by law, Psyched disclaims all warranties, express or implied, including warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

Psyched does not guarantee that:

  • The service will be error-free or always available
  • Insights or summaries will be accurate
  • AI outputs will be correct
  • Calendar or health integrations will be complete or current
  • A therapist will review shared information
  • Use of Psyched will improve therapy outcomes
  • Use of Psyched will support insurance reimbursement
  • Psyched will satisfy any professional, medical, legal, billing, or documentation requirement

21. Limitation of Liability

To the fullest extent permitted by law, Psyched and its officers, directors, employees, contractors, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, business interruption, emotional distress, clinical outcomes, or substitute services arising from or related to your use of Psyched.

To the fullest extent permitted by law, Psyched’s total liability for any claim arising from or related to the service will not exceed the amount you paid to Psyched in the 12 months before the claim arose, or $100 if you have not paid Psyched.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

22. Indemnification

If you use Psyched on behalf of a practice, company, organization, or professional entity, you agree to indemnify and hold Psyched harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Psyched, violation of these Terms, violation of law, or violation of another person’s rights.

23. Suspension and Termination

We may suspend or terminate your access to Psyched if we believe you violated these Terms, created risk for Psyched or others, or used the service in a way that may be unlawful, harmful, or abusive.

You may stop using Psyched at any time.

24. Changes to Psyched

We may modify, suspend, or discontinue any part of Psyched at any time. We may add, remove, or change features, integrations, pricing, or availability.

25. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and provide additional notice where required.

Your continued use of Psyched after updated Terms are posted means you accept the updated Terms.

26. Governing Law

These Terms are governed by the laws of [insert state], without regard to conflict-of-law rules.
